Terms and Conditions

Effective from 1 October 2026

These Terms govern your use of Xtasveer, a photo-delivery service for event studios operated by FutureX Consulting Services LLP (“we”, “us”). By creating an account, uploading photographs, joining an event as a guest, or paying for a plan, you agree to these Terms. If you do not agree, do not use the service.

This service analyses human faces. Section 6 sets out what that means and what you must do before you upload photographs of other people. Read it before you upload anything.

1. Definitions

  • “Studio” means a business account holder who uploads and delivers photographs — you, if you are a photographer.
  • “Guest” means a person who joins an event to view or download photographs.
  • “Content” means photographs, video, folder names, client records, quotations and any other material you upload or create.
  • “Face Data” means the numerical descriptors we derive from faces detected in Content and in guest selfies, described in section 6.
  • “Event” means a workspace containing folders, Content, guests and staff.

2. Accounts and eligibility

You must be at least 18 years old to hold an account. You are responsible for everything done through your account, for keeping your credentials secure, and for the acts of every staff member you invite.

Studio accounts carry per-member permissions. Granting a permission is your decision and your risk; we act on the permissions recorded against an account without separately verifying that they were intended.

You must give accurate information and keep it current. We may suspend an account we reasonably believe was opened with false details.

3. The service

We provide hosted galleries, bulk photo and video ingest, face-based photo matching, folder access controls, guest access by link or QR code, and studio tooling for clients, quotations, invoices and payments.

We develop the service continuously. We may add, change or withdraw features. Where a change materially reduces a paid feature you rely on, we will give reasonable notice and, if you object, refund the unused portion of your prepaid term.

4. Your obligations as a Studio

This is the most important section of these Terms. You control what is uploaded; we do not see it before you do, and we cannot judge whether you were entitled to upload it.

You represent and warrant, for every upload, that:

  • you own the Content or have the rights necessary to upload, store, process and deliver it;
  • you have obtained every consent required under applicable law from the people appearing in it — including consent to automated facial analysis — and can produce evidence of those consents on request;
  • you have told those people, in plain language, that their photographs will be uploaded to a service that detects and matches faces;
  • where a person appearing in Content is under 18, you hold verifiable consent from their parent or lawful guardian;
  • the Content does not infringe any third party’s rights and is not unlawful, obscene, defamatory or otherwise prohibited.

In data-protection terms you are the Data Fiduciary for the people in your photographs and we act as your Data Processor for that Content. The duty to obtain consent from the people you photograph rests with you, not with us. Our platform records the consent of the account performing an upload; it cannot and does not collect consent from a wedding guest who never signs in.

5. Guests

Guests join an event by link, join code or QR code. A guest may add one or more selfies so the service can show them photographs they appear in. Adding a selfie is optional — a guest can browse an event without ever providing one.

A guest may delete a face scan and its selfies at any time from their account, which also removes the matches derived from it. A Studio administrator may delete a guest’s data from an event.

Guests must not download, redistribute or publish photographs beyond what the Studio permits, and must not attempt to reach folders they have not been given access to.

6. Facial recognition

When Content is ingested, the service detects faces and converts each one into a numerical descriptor — a list of numbers representing geometric features. We do not store a separate copy of the face, and the descriptor cannot be turned back into a photograph.

When a guest adds a selfie, we derive a descriptor from it in the same way and compare it against the descriptors from the events that guest has joined, in order to show them their own photographs.

Before any face descriptor from your uploads can be stored, the account performing the upload must have accepted facial-recognition terms. We record the version accepted, the time, the IP address and the browser or application used.

You must not use the service:

  • to identify a person without a lawful basis for doing so;
  • for surveillance, policing, background checking, or assessing a person’s character, eligibility or entitlements;
  • to build, train, enrich or evaluate any facial-recognition or biometric model, whether your own or a third party’s;
  • to match a person across events belonging to unrelated clients.

Matching is probabilistic. It will sometimes miss photographs a person appears in and sometimes return photographs they do not. It is a convenience for finding pictures and nothing more. We do not warrant its accuracy and you must not rely on it as proof that a person was, or was not, present anywhere.

7. Acceptable use

You must not:

  • attempt to access another studio’s or guest’s data, or probe, scan or test the security of the service;
  • circumvent storage quotas, plan limits, folder permissions or payment gating;
  • resell, sublicense or white-label the service without our written agreement;
  • use automated means to bulk-download Content you do not own;
  • upload malware, or content designed to disrupt the service.

8. Plans, storage and payment

Plans are sized by storage. Prices are shown in Indian Rupees and are exclusive of GST, which is added at the applicable rate. Payments are processed by our payment provider; we do not receive or store your full card details.

Storage usage is measured by the file sizes recorded for uploads after your chosen compression settings, with photos and videos sharing the same allowance. On paid plans, deleting files frees storage for reuse. Free has a lifetime upload allowance: deleting files does not restore that allowance. Further uploads pause when the applicable allowance is exhausted, until paid storage is freed or your plan provides more capacity. Pay-as-you-go usage is billed monthly on the storage in use during that month.

Compression is available where included in your paid plan and follows the settings you choose. References to 90% compression or up to 10x original-photo capacity are estimates, not guaranteed reductions or extra stored capacity. Actual file sizes and image quality depend on the source files and settings. Compression can reduce quality; a compressed upload is not an unchanged original. Keep original files separately.

Unless a different setting is shown, photo-count examples assume 12 MB originals reduced by 90% to about 1.2 MB each. Calculator counts follow your selected compression. Yearly examples assume paid capacity throughout the year and the studio deleting event photos and reusing the space: twelve cycles for one-month retention or twenty-four cycles for half-month retention. With 50 GB, these illustrate approximately 5,00,000 or 10,00,000 photos yearly. They are neither storage at once nor annual upload allowances, and they do not set automatic deletion after a retention period. Actual counts vary with file sizes, compression and other stored media.

Yearly paid plans include a free storage boost that doubles the normal stored-file quota for one month of your choice, once. The extra capacity carries no boost charge for that month; your base yearly plan remains payable. The boost does not renew automatically or recur each year. When it ends, your normal quota applies again.

We start reminding you 7 days before the boost ends. To keep files above your normal quota, extend the boost under the terms offered at that time; otherwise reduce your usage before expiry. If usage remains above the normal quota after the boost ends and the reminders are completed, remaining over-limit Content is deleted. Download and keep any files you need before deletion.

Paid plans renew automatically for the same term unless cancelled before the renewal date. Yearly plans are charged in advance for the year.

If a payment fails, we may suspend uploads and guest access after reasonable notice. We may change prices with at least 30 days’ notice, effective from your next renewal.

9. Cancellation and refunds

You may cancel at any time from your account. Cancellation stops the next renewal; it does not shorten the term you have already paid for, and your galleries remain available until that term ends, subject to the storage limits and boost-expiry rules in section 8.

Fees already paid are non-refundable except where these Terms say otherwise, where a refund is required by law, or where we withdraw a paid feature you relied on. Refunds, where due, are made to the original payment method within 7 working days of approval.

Our Cancellation and Refund Policy sets this out in full, including how to cancel, what happens to your galleries afterwards, and how refunds are paid. It forms part of these Terms.

10. Ownership of Content

Your Content stays yours. We claim no ownership of it.

You grant us a limited, non-exclusive, worldwide licence to store, copy, compress, transcode, index, derive face descriptors from, and transmit your Content, solely to operate the service for you. The licence lasts only as long as the Content is on the service and ends when it is deleted.

We will not use your Content to advertise the service, and we will not use it to train machine-learning models.

11. Suspension, termination and your data

We may suspend or terminate an account that breaches these Terms, that is used unlawfully, or whose payment has failed and remains unpaid after notice. Where the breach is serious or unlawful — particularly a breach of section 4 or 6 — we may act immediately and without notice.

You may close your account at any time. On closure or termination we delete your Content and derived Face Data within 30 days, except where we must keep records to comply with law. Export what you need before you close the account; after deletion we cannot recover it.

12. Availability and disclaimers

We work to keep the service available and your Content safe, but we do not promise uninterrupted or error-free operation. The service is provided “as is” to the extent the law allows.

You are responsible for keeping your own copies of your photographs. The service is a delivery and workflow tool; it is not a backup service, and you must not treat it as your only copy.

13. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or anticipated savings.

Our total liability arising out of or in connection with these Terms is limited to the fees you paid us in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits liability that cannot lawfully be limited, including for fraud, or for death or personal injury caused by negligence.

14. Indemnity

You will indemnify us against claims, losses and reasonable legal costs arising from your Content, from your breach of section 4 or 6, or from a claim by a person appearing in your Content that you lacked the consent required to upload or process their image.

15. Changes to these Terms

We may update these Terms. For material changes we will give at least 30 days’ notice by email or in the application. Continuing to use the service after a change takes effect means you accept the updated Terms; if you do not, you may cancel and we will refund the unused portion of your prepaid term.

16. Governing law and disputes

These Terms are governed by the laws of India. The courts at Surat, Gujarat have exclusive jurisdiction, save that either party may seek urgent injunctive relief in any competent court.

Before commencing proceedings, please contact us — most disputes are resolved faster in writing than in court.
